Nordic Claim another victory in Club Monte Anfi

The Nordic Consulting is pleased to announce a claim victory on behalf if its clients Mr and Mrs Utby. This sentence was issued on the 11th October 2022 by court number 5 in San Bartolomé de Tirajana, Gran Canaria.

The couple were suing to annul two timeshare contracts for so-called floating weeks in Club Monte Anfi. These were purchased from Anfi Sale SL in 2008 even though sales of such contracts were proclaimed illegal as far back as 1999.  The Utbys had paid nearly €39.000 for the two contracts and enjoyed the use for 11 years. 

The judge awarded €23,791.37 plus legal interest, which corresponds to the unused portion of the contracts, plus legal interest and costs. The clients were also awarded €18,726.69 euros plus legal interest and costs, as a penalty to the defendant because this amount was paid by the client in the “cooling off period” when no payments should have been made.

Miguel Rodriguez, head lawyer for the Nordic Consulting, expects the payment to the clients to now be processed though the bankruptcy process which Anfi is currently a part of. He also notes that in order to make claims like this one – it is important that timeshare owners do not sign a new contract with Anfi, as doing so will eliminate the chance to litigate.

If you own an Anfi timeshare contract you might want to check your options before signing any new contracts offered by the company. If you bought timeshare or “points” in Spain after 1999 then it is likely that you can claim your money back plus compensation.
