Confirmed – Excel overcharged community fees by 27.5%

The Nordic Consulting has been taking a lot of phone calls from worried owners in Beverly Hills The Suites recently. Their statements for the first quarter of 2020 showed a huge increase in community fees of 27.5%. Many owners say they contacted the community directly but did not get a satisfactory answer from Excel Hotels and Resorts – the company that manage the community.

The Nordic Consulting employed it´s lawyer Luis Garcia Sanchez Yanes to see if this was legal. Apparently not – community fee increases should have been authorised at an AGM by a majority vote of the owners. Beverly Hills The Suites has not held an AGM since January 2019.

We believe the only hope for change in Beverly Hills The Suites is for owners to demand that a new company takes over the resort management. We are working hard now to unite owners for this purpose. If you have a property in Beverly Hills The Suites there are two things you can do:

  1. The first step is to give notice that you do not want to continue with the current rental contract.
  2. The second step is to use you voice in the community of owners. Excel has not formally announced the date of the next AGM but is saying it will be in October 2020. If you are an owner in the resort, make sure you contact The Nordic Consulting about representation at that meeting. Remember – every vote counts if you want to bring about change.

 

In summary he demanded to know:

  1. what was the reason for the increase in community fees?
  2. where was the audit report for the community accounts as agreed in January 2019 at the last AGM?
  3. why no AGM had been called yet for the current year?

The response from Excel to this correspondence was immediate. The very next day, Wednesday the 3rd June, Excel finally sent emails to owners to address these serious issues.

 

Excel claims that the increase in community fees was due to “a problem with our computer system”. Time will tell if Excel really is planning to increase community fees again this year.
